For Buyers

1. General Information

2. Account and Eligibility

  • Account Requirement: Buyers must create an account to place and manage orders.
  • Age Restriction: While there is no strict minimum age for purchasing, minors (under the legal age of majority in their country) must have a parent or legal guardian supervise and approve their purchases. CartFav is not responsible for unauthorized purchases made by minors.
  • Account Accuracy: Buyers must provide accurate information during account registration. CartFav reserves the right to suspend accounts that violate these terms.

3. Ordering and Payments

  • Placing an Order: When an order is placed, the buyer agrees to pay the listed price plus any applicable taxes and shipping fees.
  • Payment Methods: Payments are securely processed through Verifone. CartFav does not store or handle payment information.
  • Order Cancellation: Orders may be canceled before dispatch. After dispatch, cancellations are subject to the Refund and Return Policy.

4. Shipping and Delivery

  • Vendor-Managed Shipping: Vendors handle their own shipping. Buyers must check the vendor’s shipping policy before ordering.
  • Delivery Time: Estimated delivery times are displayed at checkout, but delays may occur due to shipping conditions.
  • Non-Delivery: If an order is not delivered within the stated timeframe, buyers may be eligible for a refund per the Refund and Return Policy.

5. Returns and Refunds

  • Refund eligibility is determined by our Refund and Return Policy.
  • Refunds are processed through CartFav once an issue is verified.
  • Once payments have been released to the vendor, refund responsibility shifts to the vendor, with CartFav overseeing the process.

6. Data Protection and Security

  • Privacy: Buyer data is collected only for account management and order processing, as detailed in our Privacy Policy.
  • Security: We use SSL encryption, Cloudflare security, and Wordfence monitoring to protect user data.
  • Data Retention:
    • Order history is stored for 5 years for legal and tax purposes.
    • IP addresses are stored for 1 year for security and fraud prevention.
  • Third-Party Services: Payment processing, analytics, and security are managed through third-party providers (Verifone, Cloudflare, Google Analytics, etc.), which have their own privacy policies.

7. Dispute Resolution and Legal Compliance

  • Jurisdiction: These Terms & Conditions are governed by the applicable international eCommerce laws, as well as the laws of Pakistan. In case of any conflict, the laws of Pakistan shall take precedence
  • Legal Compliance: Buyers must comply with any applicable tax and trade laws in their location.
  • Dispute Handling: Any disputes will be handled according to the dispute resolution policy in the Refund & Return Policy.

For Sellers (Vendors/Brands)

8. Seller Eligibility and Account Registration

  • Minimum Age: Vendors must be at least 18 years old to register.
  • Verification Process: Only verified brands are allowed to sell on CartFav. Vendors must provide brand details, including legal business information.
  • Account Responsibility: Vendors must maintain accurate account information. Failure to comply may result in suspension.

9. Listing Products and Selling Obligations

  • Allowed Products: Vendors may only sell products that comply with global trade laws. Prohibited items include counterfeit goods, illegal products, and restricted adult content.
  • Product Accuracy: Vendors must provide clear and truthful product descriptions.
  • Pricing: Vendors are responsible for setting their own prices.

10. Order Fulfillment and Shipping

  • Shipping Responsibility: Vendors manage their own shipping and must specify available shipping regions (local/global).
  • Order Processing Time: Vendors must process orders within the time specified on their listings.
  • Late Delivery: If a vendor fails to deliver within the stated time, refunds may be issued to the buyer, and penalties may apply accordingly to the seller agreement.

11. Payments and Commissions

  • Payment Holding Period: Payments from buyers are held in CartFav’s account until the order is confirmed as delivered without issues.
  • Commission: A fixed commission is deducted from the vendor’s earnings per sale.
  • Payouts to Vendors: Once the payment is released, vendors are responsible for handling refunds and customer disputes.

12. Vendor Conduct and Compliance

  • Prohibited Actions:
    • Selling unverified or restricted products.
    • Using false advertising or misleading descriptions.
    • Using customer data for marketing without consent.
  • Account Suspension: Vendors violating policies will receive warnings. After multiple violations, they may be suspended from making new sales. Funds from completed orders will remain withdrawable.

13. Data Protection and Security

  • Customer Data Usage: Vendors receive customer shipping details only for order fulfillment and cannot use this information for any other purpose.
  • Security Measures: Vendors must ensure they handle data securely and comply with data protection laws.

14. Legal Compliance and Dispute Resolution

  • Tax Compliance: Vendors are responsible for handling their own tax reporting based on their country’s regulations.
  • Jurisdiction: These Terms & Conditions are governed by the applicable international eCommerce laws, as well as the laws of Pakistan. In case of any conflict, the laws of Pakistan shall take precedence
  • Dispute Resolution: CartFav reserves the right to mediate disputes between buyers and vendors.

15. Updates to These Terms

CartFav may update these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
